Heard learned counsel for the petitioner. Sri Govind Saran learned counsel has put in appearance on behalf of the respondents.

It is not disputed that the impugned order has been passed by the Commandant, 38 Battalion, C.R.P.F., Smailpur, Jammu. No cause of action has arisen in territorial jurisdiction of this Court. In view of the Full Bench Decision of this Court in Rajendra Kumar Misra Vs. Union of India & other 2005 (1) UPLBEC 108, this writ petition is not maintainable before this Court.

It is accordingly, dismissed on the ground of territorial jurisdiction.
