Heard Sri P.K. Tiwari, learned counsel for the petitioner and Sri Ramendra Pratap Singh who has put in appearance for respondents no. 1 to 5.
It is contended by learned counsel for the petitioner that against the impugned order of discharge he has already filed an appeal under Section 26 of the Army Act 1950 but the same has not been decided so far. A copy of appeal is placed on record as Annexure 4 to the writ petition. Sri Ramendra Pratap Singh, appearing for the respondents states that in case any appeal filed by the petitioner is pending and has not been decided by the competent authority, the same shall be considered and disposed of.
In this view of the matter, this writ petition is disposed of finally with the direction that the aforesaid appeal of the petitioner, if not already decided by the competent authority, the same shall be considered and disposed of expeditiously, preferably within three months from the date of production of a certified copy of this order.
