Heard learned counsel for the petitioner. Sri J.N. Singh has put in appearance on behalf of the respondents. Petitioner has stated that he is suffering from Spondilitis with P.I.D. and under medical advice, is not able to undertake the regular work of conductor and has been advised to discharge lighter duties. The medical board constituted by the respondents has also submitted a similar report on 9.11.2004 a copy whereof is on record as Annexure-6 to this writ petition. He has stated that pursuant to the said report, he was discharging lighter duties at Central Bus Station, Jhakarkati where he was working at the relevant time and from where he has been transferred by the impugned order at Ajaj Nagar Depot.
In view of the fact that the Medical Board of UPSRTC has submitted a report on 9.11.2004, it is made clear that at the place of transfer also, the authorities shall assign such duties to the petitioner as are commensurating with the Medical Board's Report dated 9.11.2004.
with the above observation, the writ petition is dismissed.
