The petitioners are the defendants in Original Suit No. 150 of 2005 which had been filed for cancellation of the sale-deed. Along with the plaint, an application for grant of ad-interim injunction was also filed which was allowed by the Trial Court. The Appeal filed by the defendants was also dismissed and the review petition was also dismissed. Learned counsel for the petitioners has not been able to point out any infirmity in the orders passed by the Courts below which may warrant interference by this Court under Article 226/227 of the Constitution.
Learned counsel for the petitioners then contended that the suit itself may be decided expeditiously.
In view of the facts and circumstances of the case, the writ petition is disposed of requesting the learned Additional District Judge (Court No. 6) Bijnor to decide Original Suit No. 19 of 2005 expeditiously preferably within a period of one year from the date of filing of a certified copy of this order before the Court.
