Sri C. K. Rai has accepted notice on behalf of respondent No. 3. Learned standing counsel appears for respondents No. 1, 2, 4 to 6. Respondents are allowed four weeks' time to file counter affidavit.
Learned counsel for the petitioner submits that there are no allegation of any embezzlement or financial irregularity on the part of the petitioner who was working as Assistant Teacher. There being no allegation of embezzlement against the petitioner, the suspension order is not justified. Learned counsel for the petitioner submits that the constructions were completed in 2005 and the report was also submitted by the Junior Engineer. Let counter affidavit be field within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List on expiry of the aforesaid period.
In the meantime the suspension order dated 6.10.2007 shall remain stayed. However, the enquiry against the petitioner may go on.
