Mohd. Zahir Khan v. Shri Prashant Trivedi & Ors - CONTEMPT APPLICATION (CIVIL) No. - 3954 of 2007 RD-AH 17495 (6 November 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon. Dilip Gupta, J.
The petitioner alleges violation of the interim order dated 10.1.2001 passed by this Court in Writ Petition No. 22168 of 2000. The Court directed that after the exchange of the affidavit the petition may be listed and in the meantime status quo with regard to the posting of the members of the petitioner's association shall be maintained.
It has been stated in paragraph 8 of the affidavit filed in support of the contempt petition that the applicant had been shifted from his Camp Office to Collectorate Office and, therefore, the order has been wilfully disobeyed. In my opinion, there is no wilful disobedience of the order passed by this Court. This order, however, will not prevent the petitioner from moving an application in the pending writ petition.
Subject to the observations made above, the contempt petition is dismissed.
