Heard counsel for the petitioner and learned standing counsel for the respondents.
The licence of fair price shop of the petitioner was canceled by the Sub Divisional Magistrate, Chandausi, District Moradabad, vide order dated 7.7..2007, against which the petitioner filed an appeal along with stay application before the Commissioner, Moradabad Division, Moradabad. It is alleged that the Commissioner rejected the stay application but the appeal has not yet been disposed of. It is submitted by the petitioner's counsel that the petitioner's agreement was suspended but thereafter restored and in the final order passed by Sub Divisional Magistrate no particular irregularity has been found..
Considering the facts an circumstances, this petition is finally disposed of with the direction to respondent No.2 to decide the appeal of the petitioner preferably within a period of three months from the date of production of a certified copy of this order before him.
Till disposal of the appeal the operation of the order dated 7.7.2007 passed by Sub Divisional Magistrate shall remain stayed. While disposing of the appeal, the Commissioner will not be influenced by any observations made in this order.
