Nasim Ahmad v. Union Of India And Others - WRIT - A No. - 54877 of 2007 RD-AH 17504 (6 November 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
C.M. W.P. No. 54877 of 2007
Nasim Ahmad Vs. Union of India and others
Hon'ble Sudhir Agarwal, J.
Heard learned counsel for the petitioner and Sri P.C. Shukal for the respondents.
This writ petition involves recruitment in Central Government and it is a service matter as defined under the Administrative Tribunal Act, 1985. In view of the law laid down by Hon'ble Apex Court in L. Chandra Kumar Vs. Union of India and others reported in AIR 1997 SC 1125 (para 93) it is evident that in such matters this Court cannot entertain writ petition at the first instance and remedy lies by filing Original Application under Section 19 of the aforesaid Act before the Tribunal.
In this view of the matter, the writ petition is dismissed as not maintainable.
