Sanjai Kumar Tripathi v. Union Of India Thru' Secretary Rural Development & Others - WRIT - A No. - 54041 of 2007 RD-AH 17534 (6 November 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
C.M.W.P. No. 54041 of 2007
Sanjal Kumar Tripathi Vs. Union of India and others
Hon'ble Sudhir Agarwal, J.
Heard learned counsel for the petitioner.
The petitioner has challenged the advertisement dated 28.09.2007 on the ground that the qualification published therein are not correct inasmuch as, if the respondents have prescribed qualification of diploma Civil, Mechanical or Electrical Engineering then the minimum qualification cannot be Intermediate but it has to be High School.
However, I do not find any merit in the writ petition inasmuch as, prescription of a qualification for a particular post is within the domain of the authorities who are making recruitment and, therefore, it cannot be said that the qualification prescribed by the advertisement determined by the authorities can be interfered unless it can be shown to be arbitrary and violative of Article 14 and 16 of the Constitution of Indian. Except of bare averments, nothing substantial has been paced to show that the above qualification prescribed by the authorities is per se arbitrary or otherwise violative or any statutory provision.
The writ petition, therefore, lacks merit and is accordingly dismissed.
