The petitioners are the defendants of Original Suit No.495 of 1991 that had been filed for cancellation of the sale confirmation order dated 9th May, 1988 and the certificate of sale deed dated 26th May, 1988. Along with the plaint an application for grant of temporary injunction was also filed. The Trial Court rejected the injunction application but the Appellate Court has allowed the Appeal and directed the parties to maintain status quo.
Learned counsel for the petitioners has not been able to point out any infirmity in the order passed by the Appellate Court which may warrant interference of this Court under Article 226 of the Constitution.
Learned counsel for the petitioners then contended that the suit may be directed to be decided expeditiously.
The petition is disposed of with a direction upon the Court below to decide the suit expeditiously preferably within a period of one year from the date a certified copy of this order is produced before the Court below.
