Heard learned counsel for the petitioner and the Standing counsel.
The petitioner by means of the present writ petition has prayed for a writ in the nature of mandamus commending the respondents to consider him for appointment on compassionate ground as his mother Smt. Sushila Kumari, who was an Assistant Teacher had died in harness. The petitioner claims himself to be the adopted son of the deceased and her dependent.
Admittedly, the application of the petitioner for giving compassionate appointment has not yet been considered. Learned Standing counsel submits that the application of the petitioner shall be considered expeditiously by the respondent No. 3 and as such the petition may be disposed of with suitable directions.
This Court can not act as an appointing authority. At best it can only issue appropriate directions for consideration of the application of the petitioner. Therefore, in view of the aforesaid facts and the submissions made, the petition is disposed of with the direction to the respondent No. 3 Secretary Basic Shiksha Parishad U.P., at Allahabad to consider and decide the application of the petitioner for compassionate appointment in place of his alleged deceased mother Smt. Sushila Kumari who had died on 11th March 2004. The respondent No. 3 shall dispose of the application in accordance with law by a speaking order as expeditiously as possible preferably within a period of six weeks from the date of production of the certified copy of this order.
With the above observation, the writ petition is disposed of.
