It is submitted by the petitioner's counsel that a complaint regarding certain financial irregularities was filed by the petitioner in accordance with the Uttar Pradesh Panchayat Raj (Removal of Pradhans, Up-Pradhans and Members) Enquiry Rules, 1997 against the respondent no.5 and on the basis of the said complaint a preliminary enquiry report has also been submitted in which according to the petitioner it was prima facie found that the Pradhan was guilty of financial irregularity but no action is being taken upon the said report and complaint. It is stated that the petitioner has already filed a representation in this connection dated 11.10.2007 to the District Magistrate, Baghpat but the District Magistrate, Baghpat is sitting tight over the matter.
I have heard the learned Standing Counsel also.
In the facts and circumstances of the case if the petitioner files a copy of the said representation along with other papers relied upon by him and the certified copy of this order the District Magistrate, Baghpat may look into the matter and pass appropriate order in accordance with law. It is made clear that no opinion upon the merits of the petitioner's case is being expressed by this court.
With these observations the writ petition is disposed of.
