Sri R.K. Ojha, learned counsel appearing for the petitioner at the outset stated that he is not pressing the reliefs No. (b), (c) and (d) and is confining this writ petition only to the extent the prayer has been made in relief No. (a) i.e. seeking mandamus commanding the respondent no. 2 to decide petitioner's matter for financial concurrence which is pending before him.

It is said that pursuant to the Government Order dated 17.04.1998, permitting the Committee of Management to make appointment on honorarium basis, the petitioner has been selected by the Committee of Management, Udit Narain Snatkottar Mahavidyalaya, Padrauna, District Kushinagar, respondent no. 5 and the recommendation for his appointment has been sent for approval to the respondent no. 2 vide letter dated 21.11.2006 but till date the respondent no. 2 has not passed any order.

Learned Standing Counsel at this stage submitted that in case any final order has not been passed by the respondent no. 2 on the reference made by the Committee of Management vide letter dated 21.11.2006, the same shall be decided expeditiously.

In view thereof, we dispose of this writ petition finally directing the respondent no. 2 to take final decision on the reference made by the Committee of Management vide letter dated 21.11.2006 with respect to appointment of petitioner on honorarium basis and pass appropriate order in accordance with law expeditiously, preferably within a period of one month from the date of production of certified copy of this order.
