Heard Sri P.K. Singh, learned counsel for the petitioner, learned standing counsel appearing for respondents no. 1 and 3 and Sri V.P. Varshney appearing for respondent no. 2.
Challenging the cut of date with respect to age, the petitioner has sought a writ of mandamus commanding the respondents to grant him relaxation in age and to consider him for recruitment to the post of Homoeopathic Medical Officer. This issue has already been considered by this Court in Writ Petition No. 52243 of 2007 Dr. Rajeev Ranjan Misra & others Vs. State of U.P. & others decided on 30.10.2007 and it has been held that such relief cannot be granted. The issue raised in this writ petition is squarely covered by the aforesaid judgement. In view of the reasons contained therein, the petitioner in this writ petition also cannot be granted any relief. The writ petition, therefore, lacks merit and is dismissed.
