The petitioner is aggrieved by the order dated 6th November, 2007 passed by the learned Civil Judge (Junior Division), Kanpur Nagar rejecting the application filed by the petitioner with a prayer that he may not be dispossessed from the property in dispute.
The Original Suit for eviction and arrears of rent against Sri Shyam Narain Verma, the father of the petitioner, had been decreed and Execution Case No.5 of 1979 is pending. It is said that Shyam Narain Verma retired from service and thereafter vacated the premises and handed over the possession of the same to the landlady Smt. Raj Kishori who then executed an unregistered agreement to sell in favour of the petitioner. Smt. Raj Kishori has also executed a sale deed in favour of Narendra Kumar Sahu.
The petitioner has filed the application in the Execution Case only on the basis of unregistered agreement to sell. The same does not confer any right upon the petitioner. His application was, therefore, rightly rejected.
The writ petition is totally misconceived and is, accordingly, dismissed.
