The petitioner is the plaintiff in the Original Suit No.851 of 2006. Along with the plaint an application for grant of temporary injunction was moved in which an order of status quo was passed. Misc. Appeal was filed by the defendant which has been partly allowed by the District Judge by the order dated 25th October, 2007 and the order of the Trial Court was modified to the extent that the defendant could complete the construction on the disputed land. Subsequently affidavits have been filed by both the parties today which show that the building has been constructed. Learned counsel for the respondent states that the respondents shall not raise any further construction.
This petition is, therefore, disposed of with a direction that the respondents shall not raise any new construction on the property in dispute during the pendency of the suit.
