Heard counsel for the petitioner and learned standing counsel for the respondents.
The licence of fair price shop of the petitioner was cancelled by the Deputy District Magistrate, Devband, District Saharanpur, vide order dated 22.10.2007, against which the petitioner filed an appeal along with stay application before the Commissioner, Saharanpur Mandal, Saharanpur. It is alleged that the Commissioner admitted the appeal but rejected the stay application. No ground for interference has been made out.
Considering the facts an circumstances, this petition is finally disposed of with the direction to respondent No. 1 to decide the appeal of the petitioner within a period of three months from the date of production of a certified copy of this order before him.
Till disposal of the appeal the attachment of the fair price shop of the petitioner may continue but no fresh allotment of the fair price shop in question shall be made, if not already made.
