Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record.
It is contended by the learned counsel for the petitioner that the petitioner has been granted licence to run the medical store to sell the Homeopathy medicines, a copy of the same is appended as Annexure 2 to the petition. He submits that it is alleged that the petitioner is practicing as a Doctor in Homeopathy medicines. His further contention is that the allegations are false.
On the other hand, learned AGA prays for and is granted three weeks' time to file counter affidavit.
List on 07th March 2007.
The investigation of case crime no. 11 of 2007 under Section 15(3) of the Indian Medical Council Act 1956 and Sections 419, 420 IPC PS Auraiya, Distt. Auraiya shall go on but the arrest of the petitioner shall not be effected till the date fixed, provided he co-operates with the investigation and shall not act as medical practitioner, as alleged.
