Heard learned counsel for the petitioners and the Standing counsel for the respondents No. 1,2 and 3. No one is present for respondents No. 4 to 13 nor any counter affidavit on their behalf has been filed.
The petitioners are working as Basic Health Workers (female) in Primary Health Centre. They are claiming promotion on the post of Swastha Parivechak (female). The petitioners contend that they are senior to respondents No. 4 to 13 but they have been ignored in granting promotion while respondents No. 4 to 13 who are juniors to them have been promoted. The petitioners have already represented to the Additional Director of Medical Health and Family Planning, respondent No. 2 who is competent authority to determine the seniority of the petitioners and about their claim for promotion. Accordingly, respondent No. 2 is directed to consider and decide the representation of the petitioners with regard to their promotion as expeditiously as possible preferably within a period of two months from the date of production of certified copy of this order along with a fresh representation. In case the fresh representation is filed by the petitioners before respondent No. 2, he shall consider and decide the same by a speaking order after affording due opportunity of hearing to the petitioners as well as respondents No. 4 to 13.
The writ petition is disposed of with the above observation.
