Heard learned counsel for the petitioner and the Standing counsel.
The petitioners are claiming age relaxation for the purposes of special BTC training 2004.
Learned Standing counsel was granted six weeks time to file counter affidavit vide order dated 28.10.2004 but till date no counter affidavit has been filed.
Learned counsel for the petitioners has submitted that the controversy has already been settled by this Court vide judgment and order dated 18.3.2005 passed in writ petition No. 29494 of 2004 (Sandhya Jain Vs. State of U.P. and others) and in connected writ petitions. In the said case this Court has held that non providing of age relaxation to physically handicapped candidates is arbitrary and therefore had issued directions that candidates who have applied in the physically handicapped category shall be extended aged relaxation benefit of 5 years as has been extended to such physically handicapped category candidates in the Special BTC (Urdu) 2005.
In view of the aforesaid, the writ petition is allowed in the same terms and conditions as contained in the judgment and order of this Court dated 18.3.2005 Sandhya Jain (Supra) and others and the petitioners shall be given age relaxation benefit as held therein.
