HIGH COURT OF JUDICATURE AT ALLAHABAD

Court No.32

Civil Misc. Writ Petition No.56269 of 2007

Dr. Usha Vatsa v. State of U.P. and others.

Hon'ble S. Rafat Alam, J.

Hon'ble Sudhir Agarwal, J.

In the instant petition the petitioner is aggrieved by the order of the State Government dated 24.10.2007 whereby she has been placed under suspension.

Heard learned counsel for the petitioner and also perused the record.

From a perusal of the report dated 6.10.2007 (annexure 2) it appears that one of the allegation against the petitioner is that she has signed forty eight blank cheques. It further appears from the impugned order that a departmental proceeding is under contemplation against the petitioner and thus, we do not find any reason to interfere with the order of suspension. However, in view of the Government Orders No. 7/8/77 - Ka -1 dated 30.7.1977 and No.13/13/93 - Ka - 1/1993 dated 10.2.1993 wherein the State Government has provided that the departmental proceeding is required to be concluded expeditiously and within a period of six months, it is provided that in the event the State Government decides to proceed with the departmental proceeding against the petitioner the same may be concluded expeditiously and within a period six months from the date of initiation of proceeding. It is further provided that if the concurrence from the Public Service Commission is required for passing final order by the disciplinary authority, the period consumed therein shall be excluded.

With the aforesaid direction this petition stands finally disposed of.
