Heard learned counsel for the petitioners and learned A.G.A. for the State.
Perused the allegations of the F.I.R. and the material on record.
The victim Neelam, petitioner no. 2, is present in Court. She has been identified by her lawyer.
It is submitted by learned counsel for the petitioners that the petitioner no. 2 is aged about 19 years and she has married with petitioner no. 1 out of her own free will and both are major.
Issue notice to respondent no. 4 who may file counter affidavit within four weeks. In the meantime learned A.G.A. may also file counter affidavit. Learned counsel for the petitioners may file rejoinder affidavit within one week thereafter.
List on 21.1.2008.
On the said date both the petitioner nos. 1 and 2 shall appear in person and respondent no. 4 may also appear in person before this Court.
Till the next date of listing, the arrest of the petitioners namely Avinash Kumar, Smt. Neelam, Shashi Kumar and Jasoda in Case Crime No. 65631072527 of 2007 under Sections 363 and 366 I.P.C., Police Station Kotwali, District Mainpuri shall remain stayed.
