Heard learned counsel for the petitioners and learned A.G.A. appearing for the State.
We have been taken through the allegations contained in the F.I.R. and also the materials on record.
Issue notice to respondent no. 4 who may file counter affidavit within four weeks. In the meantime, learned A.G.A. may also file counter affidavit. Rejoinder affidavit, if any, may be filed within two weeks next thereafter.
List this matter after the expiry of aforesaid period.
Till next date of listing or till submission of charge sheet whichever is earlier, the arrest of the petitioners namely Yogesh Kumar @ Tunna and Subhash Chandra who are wanted in case crime No. 271 of 2007 under Sections 323, 504, 506, 427 and 452 I.P.C. and 3(1)10 S.C./S.T. Act, P.S. Hazara, district Pilibhit shall remain stayed of course subject to the restraint that the petitioners shall fully cooperate with the investigation and shall appear as and when called upon to assist in the investigation. In case the petitioners default in any manner, the above order shall cease to be operative.
