Heard learned counsel for the petitioners and learned Standing Counsel representing the respondents.
By this writ petition, the petitioners have prayed for a writ of mandamus, directing the respondents to accord consideration to the petitioners' candidature for Special B.T.C. Training Course 2007, who have passed Bachelor of Education degree from Chaudhary Charan Singh University, Meerut.
The petitioners' case is that they have passed B.Ed. in 1993 and 1994 from the aforesaid University by distant mode. The petitioners' case is fully covered by the Division Bench Judgement of this Court in the case of Gyanendra Kumar Sharma and others Vs. State of U.P. and others (Special Appeal No. 1271 of 2007), decided on 3.10.2007, in which the Division Bench has held that the candidates, who have passed B.Ed. course from the distant education or Open University, are also eligible for Special B.T.C. Training Course .
Following the proposition laid down by the Division Bench in the aforesaid case, the present writ petition is also disposed of with the observation that the petitioners, who have passed B.Ed. by distant mode from Chaudhari Charan Singh University Meerut, are also eligible for applying in Special B.T.C. Training Course 2007, provided the said degree is recognised by NCTE.
Let a certified copy of this order be supplied to counsel for the petitioner within twenty four hours on payment of usual charges.
