This contempt petition has been filed for alleged violation of the judgment and order dated 6.1.2005 passed by this Court in Writ Petition No. 312 of 2005.

The petitioner was directed to file a fresh comprehensive representation before the Executive Officer, Nagar Palika Parishad, Jaunpur (hereinafter referred to as the 'Parishad') which was to be decided in accordance with law after giving opportunity of hearing to the petitioner as well as the concerned persons expeditiously preferably within a period of six weeks from the date of filing of the same.

It has been stated in paragraph 6 of the affidavit filed in support of the contempt petition that the petitioner submitted a fresh representation on 20.1.2005 to the Executive Officer of the Parishad. There is, however, nothing on the record to indicate that the petitioner actually filed the representation along with the certified copy of the judgment as there is no endorsement about receipt on the representation.

In paragraph 7 of the affidavit, it has, however, been stated that the petitioner also sent a representation dated 18.10.2007. In such circumstances, the petitioner may submit a fresh representation along with a certified copy of the judgment and order dated 6.1.2005 and also a copy of the order passed today before the Executive Officer of the Parishad within a period of two weeks from today and upon receipt of the said representation, the same shall be decided in accordance with the judgment and order dated 6.1.2005 within a period of six weeks+.

Subject to the observations made above, the contempt petition is disposed of.
