The petitioner is the plaintiff of Original Suit No. 547 of 1997 that had been filed for permanent injunction. The petitioner also moved an application for seeking permission to repair the two Chhappars. This application was rejected by the Trial Court. The petitioner filed a Revision. The Revisional Court has observed that the said application would be decided at the appropriate stage as the application filed for temporary inunction was pending disposal and orders had also to be passed on the report of the Commissioner and the map. It is, therefore, clear that the application filed by the petitioner has not been decided and would be decided at the appropriate stage by the Trial Court.
Learned counsel for the petitioner has not been able to point out any infirmity in the order passed by the Court below which may warrant interference by this Court under Article 226 of the Constitution.
It is expected that the injunction application shall be decided expeditiously in accordance with law.
The writ petition is dismissed subject to the observations made above.
