In a pending suit, a compromise was entered into between the plaintiff and the defendant No.1. Defendant No.3 in the suit has filed this petition as he is aggrieved by the said compromise. The Courts below have rejected the application holding that both the plaintiff and the defendant No.1 had entered into a compromise and had appeared before the Court to verify it. If the plaintiff and the defendant No.1 had entered into a compromise, then the other defendants can have no other possible objection. There is no infirmity in the orders passed by the Courts below. Needless to say that the compromise entered into between the plaintiff and the defendant No.1 cannot be binding on the other defendants.
The writ petition is, accordingly, dismissed.
