Abdul Hafeez v. State Of U.P. And Others - WRIT - A No. - 57383 of 2007 RD-AH 18290 (27 November 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon'ble Ashok Bhushan, J.
Heard counsel for the petitioner.
By this writ petition the petitioner has prayed for quashing the suspension order dated 16.7.2007 by which the petitioner has been suspended on the ground that the construction in the Prathmik Vidyalaya fell down at the time of construction itself as inferior quality of the material has been used. Learned counsel for the petitioner submits that entire construction was being done by the Pradhan and the petitioner has sent information to the Assistant Basic Shiksha Adhikari by the letter dated 30.4.2007. The suspension of the petitioner is directed on the allegations as contained in the order. There being serious allegation against the petitioner, the suspension is justified. The submission of the petitioner is that the entire responsibility was of the Pradhan is a matter to be gone into in the enquiry. Whether the petitioner was responsible or not is a question of fact for which the petitioner is free to submit his explanation. No ground made out to interfere with the order. It is, however, observed that the disciplinary enquiry against the petitioner shall be concluded expeditiously preferably within a period of three months from the date of production of a certified copy of this order.
With the above observations the writ petition is disposed of.
