Chandra Kiran v. Sri Data Deen Pasi Director, Bal Vikas Evam Pustahar - CONTEMPT APPLICATION (CIVIL) No. - 4187 of 2007 RD-AH 18302 (27 November 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon. Dilip Gupta, J.
The petitioner alleges violation of the judgment and order dated 3.7.2007 passed in Writ Petition No. 27411 of 2007. The petitioner was directed to file a representation on which decision was required to be taken in accordance with law preferably within a period of two months from the date of production of the certified copy of the order.
It has been stated in paragraph 16 of the affidavit filed in support of the contempt petition that the order was sent by Registered post on 27.7.2007 but there is nothing on the record to indicate as to when the said Registered letter was received by the opposite party. In any case, the representation was required to be decided preferably within a period of two months. In such circumstances, the petitioner should wait for some more time.
The contempt petition is, accordingly, dismissed as premature.
