Heard counsel for the petitioner. Sri R. K. Srivastava appearing for the Basic Shiksha Parishad and Basic Shiksha Adhikari has also produced the relevant records.

By this writ petition the petitioner has prayed for quashing the order dated 22.10.2007 passed by the District Magistrate, Deoria by which the petitioner's representation against the decision of the Gram Shiksha Samiti refusing the renewal, has been rejected. The petitioner was appointed as Shiksha Mitra for the academic session 2005-2006. He was also renewed for the year 2006-2007. With regard to session 2007-2008 his tenure was not renewed due to various complaints. Petitioner filed a writ petition No. 47560 of 2007 which was disposed of by this Court directing the District Magistrate to consider the representation of the petitioner. The District Magistrate after the order of this Court called all affected parties and heard the mater. The District Magistrate was satisfied that there was sufficient allegations against the petitioner due to which the Gram Shiksha Samiti has not renewed the tenure of the petitioner. Both the Head Master of the Institution and the Pradhan of the village appeared before the District Magistrate and has complained regarding misbehaviour of the petitioner. The District Magistrate being satisfied with the allegations rejected the representation. The order of the District Magistrate is based on consideration of relevant facts which does not warrant any interference by this Court Under Article 226 of the Constitution.

The writ petition is dismissed.
