Heard counsel for the petitioner.
The petitioner is permitted to correct the description of the respondents No. 2 and 3 .
By this writ petition the petitioner has prayed for a writ of mandamus commanding the respondents to decide the application of the petitioner praying for compassionate appointment. Petitioner's case is that the petitioner's mother who was working as Assistant Teacher in Kendriya Vidyalaya, Manauri, Allahabad died on 5.4.1999. Sri S. P. Sharma, learned counsel for the respondents no. 3 and 4 submits that Kendriya Vidyalaya Sangathan which is running the institution where the petitioner's mother was employed, have been notified under Sub-section (2) of Section 14 of the Central Administrative Tribunal Act, 1985 and the remedy of the petitioner is to file an application under Section 19 of the Central Administrative Tribunal Act, 1985 before the Central Administrative Tribunal, Additional Bench, at Allahabad.
In above view of the matter the writ petition at the first instance in this Court cannot be entertained. Petitioner may seek remedy before the Central Administrative Tribunal.
With the above observations the writ petition is dismissed.
