By the judgment and order passed yesterday, in Writ Petition No. 14343 of 2005, and the judgment and order passed today after hearing the parties in writ petition No. 19999 of 2005, the matter with regard to declaration of vacancy of disputed shop has been remitted to the Rent Control & Eviction Officer with a direction that the question of vacancy be determined afresh after allowing the parties to produce the materials before him. The Court has allowed three month's time to the Rent Control & Eviction Officer to make fresh decision. This writ petition is against the release order under Section 16 of the UP Act No. XIII of 1972 in respect of the occupation by Smt. Sita Devi on the ground floor. The hearing of this writ petition as such has to await the question of determination of the vacancy.

List on 7.4.2008. Interim order will continue to operate till then.
