Heard counsel for the petitioner and the Learned standing counsel. By consent of the parties, the writ petition is being finally disposed of.
By this writ petition, the petitioner has prayed for a mandamus directing the District Magistrate, Allahabad to consider and decide the application filed by the petitioner for grant of arm (revolver/pistol) licence.
The petitioner claims to have made an application on 20.8.2007 for grant of arm licence. The application is said to be pending. No useful purpose would be served in keeping the writ petition pending and calling for a counter affidavit. In the facts of the present case the writ petition is disposed of finally with the direction to the District Magistrate to consider and take appropriate decision on the application for grant of fire arm licence expeditiously preferably within a period of six moths from the date of production of a certified copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the claim of petitioner and it is for the District Magistrate to consider all aspects of the matter and take appropriate decision in accordance with law.
