The petitioners are the plaintiffs in Original Suit No. 531 of 2001 that had been filed for permanent injunction to restrain the defendants from interfering with the peaceful possession of the land of the petitioners. Initially the Trial Court granted an ad-interim injunction but subsequently the application for grant of temporary injunction was rejected. The Miscellaneous Appeal that had been filed for setting aside the order was also dismissed.
I have heard learned counsel for the petitioners and Sri T.S. Dabas learned counsel appearing for the respondents.
The Original Suit was filed in the year 2001. This Court while entertaining the petition on 23rd April, 2007, ordered that till the next date of listing the parties will maintain status quo in respect of the nature and possession over the land in dispute. It had also directed that further proceedings of the suit have not been stayed and the suit shall proceed with all expedition.
Having heard learned counsel for the parties and having perused the averments made in the writ petition it directed that the suit itself be decided expeditiously, preferably within a period of one year from the date a certified copy of this order is filed by either of the parties before the Trial Court and during the pendency of the suit the parties shall maintain status quo in respect of the nature and possession over the land in dispute.
Subject to the observations made above, the writ petition is disposed of.
