The petitioner who was Asstt. Teacher in Junior Basic School filed the present writ petition for issuing a writ of mandamus directing the respondent no.3 to promote the petitioner from the post of Asstt. Teacher of Primary School to the post of Asstt. Teacher Junior High School.
The case of the petitioner is that earlier he was promoted on the post of Head Master in Junior Basic School but petitioner could not join within 15 days of stipulated time as the order was not served on him within that period. The District Basic Shiksha Adhikari has also realised the mistake and again issued notice on 8.6.2006 giving one opportunity again pursuant to the same the petitioner has given a representation to the District Basic Shiksha Adhikari on 13.6.2006 but the same has not been decided.
I have heard learned counsel for the petitioner , learned Standing Counsel and Sri Arjun Singhal for the respondents.
In the circumstances of the case,the petitioner may file a representation before respondent No.3. In case any such representation is filed, it may be decided by respondent No.3 by a speaking order, if possible, within two months from the date of receipt of the representation. The petitioner will file certified copy of this order, other necessary documents and a duly stamped self-addressed envelope along with the representation. The respondent No.3 after taking decision will communicate the same to the petitioner.
With these observations, the writ petition is disposed of.
