The petitioner filed an application under Order 1 Rule 10 CPC in the pending Original Suit for being impleaded as a defendant claiming that he is a tenant of the property in dispute. In the Original Suit the dispute is as to who would be the owner of the property in dispute. The Court below has rightly rejected the application as the petitioner is not a necessary party. There is, therefore, no infirmity in the order passed by the Court below.

The writ petition is, accordingly, dismissed.
