In the instant petition, the short grievance of the petitioner is that U.P. Public Service Commission is not convening the meeting of D.P.C. for the purpose of promotion from the post of Junior Engineer to Assistant Engineer in the Minor Irrigation Department on the pretext that some interim order of this Court is operative. Learned counsel for the petitioner submits that interim order dated 24.5.2007 passed in Writ Petition No. 65992 of 2006, Jagdish Narain Vs. State of U.P. lapsed and, thus, now there is no hurdle before the Commission in convening D.P.C. meeting.
Sri Varshney, learned counsel appearing for Commission, Sri Rajeev Mishra appearing in C.M.W.P. No. 65992 of 2006 and Sri Prabhat Kumar Singh, holding brief of Sri G.K. Singh and Sri Budhwar appearing for respondents no. 4 to 8 in C.M.W.P. No. 65992 of 2006, Sri Girish Vishvkarma, learned counsel for the petitioner in C.M.W.P. No. 65992 of 2006 have no objection so far holding of D.P.C. meeting is concerned. They submit that Commission be directed to convene meeting of D.P.C. at the earliest.
In view of the submission and looking to the facts of the case and also in view of the fact that the interim order dated 24.5.2007 was not extended, hence, lapsed, as submitted by the learned counsels for the parties, U.P. Public Service Commission, respondent no. 5, is directed to convene D.P.C. meeting at an early date as per their convenience.
It is further directed that the Commission shall make the recommendation after selection at the earliest.
With the aforesaid directions, this writ petition is disposed of.
