Narendra And Others v. D.D.C. And Others - WRIT - B No. - 59619 of 2007 RD-AH 18677 (6 December 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Civil Misc. Writ Petition No. 59619 of 2007
Narendra and others
Deputy Director of Consolidation and others
Hon'ble Krishna Murari, J.
Heard learned counsel for the petitioners.
This petition arises out of chak allotment proceedings. Appeal filed by the petitioners claiming allotment of plots no. 3180, 3181 and 3182 in their chak was allowed by the Settlement Officer Consolidation. Not satisfied with the said allotment, petitioners went up in revision. Deputy Director of Consolidation vide order dated 25.8.2007 allowed the same and allotted some more area of plot no. 3181 and 3182 in the chak of the petitioners. Even though the revision of the petitioners was allowed, they have approached this Court challenging the said order mainly on the ground that they have been deprived of plot no. 3180 adjacent to their house, sehan and Abadi exists.
A perusal of the amendment chart along with the judgment of the Deputy Director of Consolidation goes to show that nowhere plot no. 3180 which was allotted in their chak by the Settlement Officer Consolidation has been taken out.
Writ petition filed by the petitioners is totally misconceived in as much as demand made by them at the state of Settlement Officer Consolidation and Deputy Director of Consolidation has been allowed.
Writ petition being misconceived fails and stands dismissed in limine.
