Sri S.D. Ojha has filed his appearance on behalf of claimant-respondent Nos. 1, 2 and 3 and he will be filing appearance on behalf of the claimant-respondent Nos. 4 and 5.
Notices be issued to the respondent Nos. 6 to 18.
Steps will be taken within one week.
As an interim measure, it is provided that the execution of the award given by the Motor Accident Claims Tribunal, Muzaffar Nagar in M.S.C. No. 437 of 2006 shall remain stayed, provided the appellant deposits the entire amount awarded before the Tribunal concerned within 30 days from today.
The claimants-respondents Nos. 1, 4 and 5 shall be entitled to withdraw 50 % of the amount as per the award without furnishing any security and the balance amount may be withdrawn by them on furnishing adequate security to the satisfaction of the Tribunal concerned. So far as the claimants-respondents Nos. 2 and 3, who are minors, their shares may be invested in a Fixed Deposit Scheme in terms of the award. In the event of default, the interim order shall stand discharged.
Rs. 25000/- deposited in this Court as pre-condition for filing the Appeal shall be remitted to the Tribunal concerned for being paid over to the claimants-respondents.
