The petitioners allege violation of the judgment and order dated 17.9.2007 passed by this Court in Writ Petition No. 44847 of 2007. The petition was disposed of with the following directions:-
"In view of the aforesaid prayer, the writ petition is disposed of directing respondent No.4 to provide up to date statement of account of petitioners' loan within a period of four weeks from the date of production of a certified copy of this order and respondent No.3 is also directed to provide copy of citation to the petitioners within the said period."
It has been stated that the Branch Manager of the Punjab National Bank, Tehsil Aonla, district Bareilly has provided the petitioners with the statement of accounts but the allegation is about the non-compliance of the other part by the Tehsildar. The averments made in the affidavit regarding non-supply of the citation by the Tehsildar to the petitioners are absolutely vague. It cannot, therefore, be said that there is any wilful disobedience of the order passed by this Court. This order, however, shall not preclude the petitioners from pursuing such other remedies as are available to them against the action of the Tehsildar in taking away Tractor belonging to the petitioners.
The contempt petition is, accordingly, dismissed.
