Heard Sri Rakesh Kumar Singh, Advocate, who has filed his power on behalf of the applicant, learned A.G.A. for the State and Sri S.K.Dubey, learned counsel for O.P. no.2

Vide my order dated 11.9.2007 I, while deciding the application under section 482 Cr.P.C., had directed the applicant to appear before the court concerned within two months in connection with the case pending against him but he did not appear before the court concerned during this period and moved this application for recall/modification of the said order. The learned counsel for the applicant submitted that the applicant could not appear before the court of the Magistrate in time due to illness of his wife and of himself and that he may be given four weeks more time to appear before the court concerned and that he shall not seek its further extension.

Taking into consideration the above submissions and undertaking, I hereby grant four weeks more time to the applicant, as prayed by him, to appear before the court concerned and during this period no coercive process shall be issued against him. In case the applicant does not appear before the court concerned during this period of four weeks granted today, no prayer for extension of time shall be entertained and coercive process shall be issued against the applicant.

The application for modification/recall of the order is finally disposed of accordingly.
