The only issue involved herein is that the formal order has not been passed by Sub-Registrar in respect of the allotted shop to the petitioner.
According to the petitioner, it is pending before the Sub-Registrar under Section 71 of the Registration Act, 1908.
We are about to send it in appeal under Section 72 of the Registration Act, 1908 but we find that no formal order has been passed by the Sub-Registrar. In such circumstance, we direct the Sub-Registrar to reach the finality upon giving fullest opportunity of hearing to the parties and passing reasoned order within one month from the date of communication of this order for the purpose of effective adjudication.
The writ petition is disposed of.
No order is passed as to costs.
Status-quo with regard to the shop as to the extent of the order passed by this court, will be maintained till one month after the order to be passed by the authority concerned.
