Roop Ram v. State Of U.P. & Others - WRIT - B No. 6085 of 2007 [2007] RD-AH 1873 (6 February 2007)
|
Hon'ble Anjani Kumar, J.
Heard learned counsel for the petitioner.
The petitioner by means of this writ petition has prayed for the following reliefs:-
(i)Issue a writ, order or direction in the nature of mandamus directing to the Respondent Nos.2 and 3 to decide the petitioner's objection dated 14.11.2006 as well as representation dated 22.12.2006, within the specific period as fixed by this Hon'ble Court.
(ii)Issue another writ, order or direction in the nature of certiorari for quashing of demarcation proceedings dated 25.10.06/01.11.06 (Annexure-3).
(iii)Issue another suitable writ, order or direction which this Hon'ble Court may deem just and proper under the circumstances of the case in favour of petitioner.
(iv)Award the cost of petition.
Admittedly the matter is pending before the authority concerned in the form of applications. The matter is pending before the authority concerned and the petitioner has sought for a writ of mandamus to direct the respondents to decide the petitioner's application/objection. The petitioner, according to the prayer in the writ petition itself, has moved these applications in November and December 2006. In these circumstances I do not find this to be a fit case for issue of mandamus. This writ petition has no force and is dismissed.
Dt: 6.2.2007.
