HIGH COURT OF JUDICATURE AT ALLAHABAD
Writ Petition (Tax) No. 1680 of 2007
Hon'ble Sushil Harkauli, J.
Hon'ble Rakesh Sharma, J.
A show cause notice dated 12.7.2007 (Annexure 1 to this writ petition) has been issued by the respondent No. 3 to the petitioner. The petitioner claims that it has submitted its detailed reply also to the show cause notice.
By this writ petition, the petitioner has made the first prayer for a mandamus directing the respondent No. 3 to take a final decision after considering the objections of the petitioner in response to the show cause notice.
The second prayer is for quashing of the said show cause notice.
After hearing the learned counsel for the petitioner and the learned standing counsel, we are not inclined to examine the second prayer at this stage but we direct the respondent No. 3 to consider the objections of the petitioner in reply to the show cause notice and to take appropriate decision with reasons dealing with those objections, within three weeks of the date on which certified copy of this order is presented before the respondent No. 3.
The writ petition is disposed of with the aforesaid observations.
