We are of the view that this appeal, under the Rules of the Court, is not maintainable agaisnt the judgement of the Hon'ble Single Judge of this Court for the reason that the order, impugned in the writ petition, was in Arbitration Case No. 25 of 2007 whereby the learned District Judge has admitted the Application under Section 34 of Arbitration &Conciliation Act, 1996. The Hon'ble Single did not entertain the writ petition on the ground that the matter is yet to be finally adjudicated upon by the learned District Judge. Against such an order of Hon'ble Single Judge refusing to entertain the writ petition arising out of the order of learned District Judge, appeal does not lie under Chapter-VIII Rule 5 of the Rules of Court. The appeal, therefore, being not maintainable, is dismissed summarily.
