The dispute in the present writ petition relates to allotment of shops constructed by Nagar Palika Parishad,  Auraiya. Initially by order dated 28.6.2005 the shop  alloted to petitioner no.2,was given to the petitioner no.1 and the shop which was allotted to the petitioner no.1 was given to the respondent no.5.

Against this order, petitioner no.2 had filed a Writ Petition No.37874 of 2006 which was dismissed on  28.6.2006. However the writ petition No.21305/06  filed by the petitioner no.1 against this order and was disposed of on 19.4.2006 granting liberty to the petitioner no.1 to file representation. Thereafter the petitioner's representation has been dismissed on 22.12.2006 hence the present writ petition has been filed.

We have heard counsel for the petitioners, Standing Counsel and Sri Manoj Misra for respondents.

Petitioner No.2 was not granted any liberty to file any representation. His writ petition was already dismissed. He cannot be granted any relief in this writ petition.

The petitioner No.1 has purchased some land from one Radhe Shyam Rathor, who was alloted 30 Sq.feet of land but  petitioner No.1 has been allotted 47.43 Sq. feet of land. Whereas the respondent no.5 was allotted 130 Sq.feet and now at present has been allotted 145.43 Sq.feet of land. The order of both of them hs increased.

We see no justification to interfere in the order.

This writ petition is dismissed.
