Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification. The applicant along with co-accused Rati were arrested by the police on 13.4.2006.It is said that one looted payal has been recovered from the possession of the applicant. The co-accused Rati whose case was on the same footing with the above applicant has been released on bail by this court on 19.12.2006 in criminal misc. bail application no. 28024 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Gulab involved in case crime no. 86 of 2006 under Sections 396, 412 I.P.C., P.S. Mursan District Hathras be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
