Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. during investigation the statements of the witnesses were recorded who stated that the applicant was seen near the alleged place of occurrence. No looted proper has been recovered form the possession of the applicant. The applicant is not having any criminal antecedent.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Mantoo Raza Khan alias Samaun Raza Khan involved in case crime no. 163 of 2006 under Sections 302,393 I.P.C., and under section 4/25 Arms Act P.S. Dashmashwamedh District Varanasi be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
