Civil Misc. ( Substitution ) Application No. 82039 of 2004.

The aforementioned Substitution Application has been filed consequent to the death of Moti Lal  (plaintiff-appellant).

Sri Ikram Ahmad , learned counsel for the applicants in the aforementioned Substitution Application  prays for  and is granted  six weeks' time for taking steps for issuance of notice on the aforementioned Substitution Application, pursuant to the order dated 30.4.2004 passed on the aforementioned Substitution Application .

In case, the requisite steps are not taken within the period mentioned above, the case will be listed before the Court under Chapter XII, Rule 4 of the Rules of the Court immediately on the expiry of the said period.

Notice will be issued by Registered Post A.D., fixing 18.12.2006.

1. Civil Misc. (Delay Condonation) Application No. 19935 of 2001.

2. Civil Misc. ( Substitution ) Application No. 19936 of 2001.

    The aforementioned applications have been filed consequent to the deaths of Dukh Haran ( defendant -respondent no.1) , Smt. Ram Bachchi ( defendant -respondent no.5) and Smt. Savitri Devi ( defendant -respondent no. 7).

It is, interalia, stated in paragraph no. 2 of the aforementioned Substitution Application ( shown at serial no. 2  above) that the said Smt. Ram Bachchi  (defendant -respondent no.5 ) died issueless in the year 1988.

Issue notice to the respective proposed heirs and legal representatives of the said Dukh Haran  (defendant-respondent no. 1) and the said Smt. Savitri Devi ( defendant -respondent no. 7), as mentioned in paragraphs nos. 1 and 3 respectively, of the aforementioned Substitution Application ( shown at serial no. 2 above).

Notice will be issued by Registered Post A.D. , fixing 18.12.2006.

Requisite steps will be taken within six weeks , failing which, the case will be listed before the Court under Chapter XII, Rule 4 of the Rules of the Court immediately on the expiry of the said period.
