Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version the applicant was armed with lathi and other co-accused persons were armed with danda. The co-accused Sewa Ram whose case was on the same footing as the applicant, has been released on bail by this court on 31.1.2007 in criminal misc. bail application no. 23651 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Vinod involved in case crime no. 51/366 of 2006 under Sections 304 I.P.C., P.S. S. Jhinjhan District Muzaffarnagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
